Terms & Conditions

The following are the terms and conditions for the National Story Slam organised by Kommune Arts Pvt. Ltd. (referred to from now onwards as ‘Kommune India’). The person submitting their story for the National Story Slam will be referred to as ‘The Participant’.

1. Eligibility:

Citizens of India aged 15 or above (as of July 1, 2020) are eligible to participate in the National Story Slam.

2. Representations and Warranties:

Each participant is allowed to submit one story for the National Story Slam. With regard to that story, the Participant hereby warrants and represents the following:

a) The Participant is the exclusive owner and sole author of the story, such that the story is the participant’s original creative work and their submission thereof will not infringe, misappropriate or violate the intellectual property, privacy or other rights of any third party;

b) The Participant’s participation in the contest, including their submission of the story, will not conflict with or violate any term or condition of any other agreement to which The Participant is a party, including but not limited to any union regulation;

c) The story being submitted has not been uploaded on YouTube, Facebook, Instagram, or any other social media website in any format;

d) There are no threatened, pending or current claims, actions or lawsuits in connection with The Participant/The Participant’s story and The Participant agrees to notify Kommune India immediately upon their notification of any such claims, actions or suits;

e) The Participant is submitting the story voluntarily on a non-confidential basis;

f) The Participant is aged 15 or above as of July 1, 2020;

g) The Participant has the right, authority, and capacity to enter into this agreement, and agrees to abide and be bound by the terms and conditions herein. If the participant is below the age of 18, then he/she/they will require his/her/their parent/guardian to warrant and represent these conditions on his/her/their behalf

3. Entry Conditions & Release:

By entering, The Participant agrees to:

a) Comply with and be bound by these Rules and the decisions of Kommune India which are binding and final in all matters relating to the contest;

b) Release and hold harmless Kommune India, and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, members, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, to invasion of privacy, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights arising out of or relating to The Participant’s Entry and/or participation in the contest; provided however, that such release will not apply to any commercial exploitation of the story by a Released Party in violation of The Participant’s rights under applicable copyright law; and

c) Indemnify, defend and hold harmless Kommune India from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to The Participant’s participation in the contest and/or The Participant’s acceptance, use or misuse of prize;

d) Indemnify Kommune from any plagiarism or misuse of the story by any 3rd party or otherwise.

4. Publicity:

Except where prohibited by law, participation in the contest constitutes The Participant’s consent to Kommune India’s and its agents’ use of The Participant’s name, likeness, and/or photographs, for promotional purposes in any media, worldwide, without further payment or consideration.

5. Release and Distribution:

If The Participant’s story is selected for the Regional Round of the National Story Slam, then the Participant will give Kommune India the first right to upload the story on its YouTube channel, Instagram channel, Facebook page, or any other social media. While the copyright of the story would remain with The Participant, the distribution rights rest with Kommune. The Participant cannot upload the story on YouTube, Instagram, Facebook without prior written permission from Kommune India.

6. Intellectual Property Rights:

a) The Participant will retain the copyright of the story after submitting it for the National Story Slam.

b) The Participant acknowledges and agrees that Kommune India and/or any participating judges may be independently developing or producing separate works which could resemble the story and incorporate concepts, themes, formats, plot lines, or characters similar to those in the story, and that the participant is not entitled to any compensation and have no rights of any kind with regard to that separate material.

7. General Conditions:

a) Kommune India reserves the right to cancel, suspend and/or modify the contest, or any part of it, if any fraud, technical failures or any other factor beyond Organiser’s reasonable control impairs the integrity or proper functioning of the contest, as determined by Organiser in its sole discretion.

b) Kommune reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the Entry process or the operation of the Contest or to be acting in violation of these Rules or in an unsportsmanlike or disruptive manner.

c) The act of allowing Kommune India to upload the submitted story on any of its social media channels does not in any way whatsoever, automatically entitle The Participant to any prize/compensation/gratification whatsoever from Kommune India and/or any Third Parties;

d) Any attempt by any person to deliberately undermine the legitimate operation of the National Story Slam may be a violation of civil law, and, should such an attempt be made, Kommune India reserves the right to seek damages from any such person to the fullest extent permitted by law. Kommune India’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.

8. Limitations Of Liability:

a) Kommune India is not responsible for:

(1) any incorrect or inaccurate information, whether caused by The Participant, printing errors or by any of the equipment or programming associated with or utilized in the contest;

(2) technical failures of any kind,

(3) unauthorized human intervention in any part of the entry process or events of the National Story Slam;

(4) technical or human error which may occur in the administration of the contest or the processing of Entries; or

(5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from The Participant’s participation in the contest

b) The Participants shall hereby indemnify Kommune India for any/all breaches/claims made in relation to the story submitted. Any misrepresentation or concealment of fact done by the Participant with respect to their story, whereby it is a plagiarised, stolen, copied, unoriginal piece of work, would not amount to any liability towards Kommune India.

c) Kommune India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental and/or emotional trauma caused to the Participant in any manner whatsoever, in relation to the National Story Slam and/or any matters arising out of the Terms and Conditions.
